New contract & commercial guidelines for IT supplier to the public sector

Intellect, the UK trade body for the IT, telecoms and electronics industries has launched new contract and commercial guidelines in conjunction with national commercial law firm, Beachcroft LLP. The guidelines have been updated to reflect the increasing importance of commercial management in technology companies. For those on either side of the public sector ICT negotiation table, the guidelines should prove useful reading.
Nearly all significant IT, telecoms and Business Process Outsourcing (BPO) service providers now have commercial directors at Board level. They lead contract negotiations ensuring relevant departments like sales, delivery and HRs requirements are met, formulate policy and process, and hire and fire external suppliers. Increasingly they play a more prominent role in negotiations than in-house legal counsel. In light of this new role that commercial directors and some contract managers hold, Intellect and Beachcroft have updated and renamed the guidelines.
The guidelines provide commercial directors in technology companies with everything they need to know about managing contracts, ranging from outsourcing, to managing risk, to advice on how to work out if the contract will be profitable. They are particularly essential for SMEs where one person often acts as contract manager, commercial manager, finance director and sales director in one, comments John Yates, partner, Beachcroft LLP.
The contract is central to successful outcomes for suppliers and customer and not something that the only the lawyers worry about. The guidelines both demystify the legal aspects and highlight the often overlooked broader commercial considerations and we believe they will be of great business benefit to our members, comments Charles Ward, COO, Intellect.
